NOTICE TO CONTRACTORS AND HOMEOWNERS
Residential Swimming Pool Safety Act
The following information and attachments are provided as a guideline for the smooth implementation of the Act:
1. The requirements of the Act will apply only to permits obtained on or after October 1, 2000.
2. The Swimming Pool Safety Act Affirmation form must be completed by the contractor and homeowner and attached to the permit application. An additional copy of the completed form is to be kept on the site at all times.
3. All projects subject to the Act will be required to have at least one of the four safety requirements specified in FS 515.27.
4. Failure of a person to comply with the requirements of the Act shall be considered as a misdemeanor of the second degree, which may be punishable as provided in FS 775.082 to FS 775.083
5. Definitions of the terms for "perimeter"; "sufficiently away from the water's edge" and "direct access from the home" shall be those contained in the Building Officials Association of Florida Guidelines for Implementation of the Residential Swimming Pool Safety Act.
