Welcome:  The Commission welcomes public comment. To ensure that the concerns of all parties are given fair consideration at the appropriate stages of the process, it is important that decorum is maintained. When addressing the Commission, please address all statements to the Chair. Since an audio record is being made of the meeting, individuals addressing the Commission are asked to use the lectern so that the comments may be recorded. In addition, individuals addressing the Commission must provide their name and address for the record. During public hearings, an announcement will be made to open and close the public comment stages of the hearing. Any written statements or other exhibits shall be provided to the staff representative, if desired to be made a part of the meeting record. Your involvement is essential to the process and is appreciated.

IV.              Public Hearing: Development Agreement:

            Applicant: Cecil Allen Construction, Inc., 18 North College Street, Eatonville, Florida 32751.

      Request: Adopt a development agreement to allow replat of the property into fourteen lots, in order to construct up to fourteen single-family detached houses, with a maximum building height of thirty-five feet (including roof elements, consistent with City zoning regulations). The development agreement would require the Developer to construct the required infrastructure to meet applicable regulations, as well as to design and construct all infrastructure improvements for the Mechanic Street area. The agreement also proposes to transfer 1.6 acres of City property, contiguous to Mechanic Street and CSX Railroad, to the Developer in exchange for upgrading the infrastructure in the Mechanic Street Area to City standards.

Location: The property is more specifically located on the west side of CSX Railroad and Orlando Avenue (U.S. 17-92), and the north side of Maitland Boulevard in the City of Maitland, Florida. The subject property includes approximately 3.8 acres.

V.                 Public Hearing: Petition No. 2006-02 (AZ)(PD) 775 South Keller Road

Applicant: Wesley Geys, The Wescar Companies, 195 International Drive, Heathrow, Florida 32746. The current property owner is Edward W. Johnson, Jr., 1505 Lakeside Drive, Deland, Florida 32720.

Request: The applicant requests to change the zoning classification from R-1, Single-Family Dwelling Residential, to PD, Planned Development District and to obtain approval of a preliminary development plan in order to construct 49 (forty-nine) multi-family condominium dwelling units, which includes 5 (five) stories, and 2 (two) stories for parking, for a total of 7 (seven) stories in height.

Location: The property is located west of Keller Road and south of Fennell Street at 775 South Keller Road. The property contains 2.51 acres more or less.

VI.              Public Hearing: Petition No. 2006-01 (ALU) City of Maitland

Applicant: City of Maitland (Fire Department), 1776 Independence Lane, Maitland, Florida 32751

Request: Amend the Infrastructure-Potable Water Sub-Element Objective 1. Policy 1.1  and Capital Improvements Element. Objective 2. Policy 2.1. Standard 2.1.3 to modify the fire flow requirements for consistency with Required Fire Flow (RFF) as established in accordance with Annex H, Fire Flow Requirements for Buildings, NFPA 1 as adopted in the Florida Fire Prevention Code which shall be modified periodically per Florida Statute 633, for all new residential subdivisions, multi-family dwellings, and commercial developments.  Also proposed is the provision for a distinction between existing single family residential and Residential Duplex and new residential subdivisions and multi-family dwellings with regard to Required Fire Flow.

VII.           Recommendation: Agreement for Redevelopment of Property and Access to City Incentives in Downtown Maitland for The Village of Lake Lily

Applicant:  MGI Properties Maitland Limited Partnership 480 N. Orlando Avenue, Suite C-222, Winter Park, Florida 32789.

Request: The Agreement will allow construction of a minimum of 40,000 and a maximum of 90,000 square feet of retail/office commercial space and a maximum of 450 multi-family residential units (at least 200 units will be condominium) and includes two parking structures and other associated improvements. A maximum height of fifty five feet (55’) to the eave (excluding roof elements and focal points not intended for human occupation) is proposed with regard to the residential and associated parking improvements on the site.  The proposed Agreement also provides for the design and construction of streetscape along U.S. Highway 17-92 and the portion of the project site fronting Lake Avenue, open space, utilities, and storm water elements.

Location: The subject property lies south of Lake Lily Park, east of the CSX railroad tracks, west of US 17-92, and north of Lake Avenue, within the City of Maitland.
